1. General

1.1. These Terms & Conditions (T&Cs) apply to all orders placed by consumers via our online shop at spoiler-regal.com (hereinafter “customer” or “you”).
1.2. A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business or profession (§ 13 BGB).
1.3. The contract language is German.
1.4. Minimum age: Orders may only be placed by persons aged 18 or over.
1.5. Storage of the contract text: We store the contract text (order data and T&Cs). We send your order data by email. Past orders are available in your customer account if you created one.
1.6. Deviating terms of the customer do not apply unless we expressly agree to them in writing.

2. Conclusion of contract

2.1. The product presentations in the online shop are not legally binding offers but a non-binding online catalogue.
2.2. By clicking the purchase button, you submit a binding order for the items in your cart.
2.3. The contract is concluded only when we accept your order by order confirmation email or by dispatching the goods.
2.4. Steps to conclude the contract / corrections: Before submitting your order, you can review and correct your entries at any time in the cart. You can cancel the ordering process at any time by closing the browser window.
2.5. We reserve the right to reject orders in individual cases (e.g., obvious pricing errors, lack of availability, justified suspicion of fraud). We will inform you without delay; any payments already made will be refunded.

3. Prices and payment

3.1. All prices include statutory VAT and are exclusive of shipping costs. Shipping costs are shown clearly during checkout.
3.2. International orders / Incoterms: We ship under Delivered at Place (DAP). Import duties, taxes and other charges at destination are payable by the recipient. These are not included in the product price or shipping costs and vary by country. Please check with the competent customs authorities in advance.
3.3. Payment methods: Payment is made via the methods we offer (e.g., PayPal, credit card, Klarna) and is processed via Shopify Payments.
3.4. When selecting third-party services (e.g., Klarna), their terms and privacy notices also apply. Please note the information provided at checkout.
3.5. Discounts / vouchers are—unless stated otherwise—not combinable, not redeemable for cash and may be subject to minimum order values / validity periods.

4. Delivery

4.1. We deliver to: Germany, all EU Member States, the United Kingdom (UK), Switzerland, and the USA. Orders from other countries are possible on request.
4.2. Delivery is made to the delivery address you specify. Partial deliveries are permitted where reasonable; no additional shipping costs arise for you as a result.
4.3. Production & delivery times: Orders are typically ready to ship in approx. 14–20 business days after receipt of payment (business days = Mon–Fri, excluding public holidays at the shipping or destination location), unless expressly stated otherwise. Transit time is additional and varies by destination. Around year-end/holidays, times may be longer. For international deliveries, lead times may be significantly longer depending on destination.
4.4. Customs clearance, local holidays and force majeure (e.g., strikes, severe weather) can cause delays beyond our control.
4.5. Unavailability: If a product becomes permanently unavailable after the contract has been concluded, we will inform you promptly and refund any payments already made.
4.6. Transport damage: Please note any visible damage upon delivery if possible and inform us without delay. Your statutory warranty rights remain unaffected; such notice helps us assert claims against the carrier.

5. Right of withdrawal

5.1. Germany, EU and UK: Consumers in Germany, the EU and the UK have a statutory 14-day right to cancel. Details (start of the period, exceptions, consequences, model form) are set out in our Right of Withdrawal notice.
5.2. Outside the EU/UK (e.g., USA, Switzerland): We do not grant a contractual right to cancel.
5.3. Return shipping costs: Unless stated otherwise in the Right of Withdrawal, you bear the direct cost of returning the goods.
5.4. Statutory exceptions to the right of withdrawal (e.g., goods made to customer specifications) remain unaffected and apply as per the Right of Withdrawal.

6. Returns

6.1. Returns are accepted only within the scope of the statutory or contractually granted right of withdrawal.
6.2. The customer bears the direct return shipping costs.
6.3. In the event of withdrawal, we reimburse all payments including the cost of standard outbound delivery without undue delay and at the latest within 14 days from receipt of the return or proof of dispatch. Deductions for diminished value apply only where the loss in value results from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
6.4. Please use the return address provided by us for returns and include the order reference to enable swift processing (optional but helpful).

7. Retention of title

The goods remain our property until payment has been made in full.

8. Warranty (statutory liability for defects)

8.1. Statutory defect liability applies. For new goods, the limitation period is two years from delivery.
8.2. Images (e.g., 3D renderings) are for illustrative purposes. Depending on lighting and display settings, colour deviations may occur; this alone does not constitute a defect.
8.3. Assembly, use and care instructions must be observed. Failure to do so may exclude defect claims to the extent the defect is caused by such non-compliance.
8.4. Guarantees in the legal sense are only given if expressly designated as such and communicated in detail. Statutory rights remain unaffected.

9. Liability

9.1. We are fully liable for damages resulting from intentional or grossly negligent breaches of duty and for damages resulting from injury to life, body or health.
9.2. In cases of simple negligence, we are liable only for breaches of material contractual obligations (cardinal duties); in such cases, liability is limited to the foreseeable, typical damage.
9.3. Liability under the Product Liability Act, in the case of an assumed guarantee of quality, and in cases of fraudulent concealment of a defect remains unaffected.
9.4. Any further liability is excluded.

10. Data protection

10.1. We take the protection of your personal data seriously. Details of processing can be found in our Privacy Policy (available in the shop). There we also inform about third-party payment services (e.g., Klarna) and their data processing.

11. Dispute resolution, choice of law and jurisdiction

11.1. The European Commission provides a platform for Online Dispute Resolution (ODR): https://ec.europa.eu/consumers/odr. Our email address is info@ellendt-ecom.de. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body.
11.2. These T&Cs are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of your country of residence remain unaffected.
11.3. Places of jurisdiction are determined by the statutory provisions.

12. Final provisions

12.1. Should individual provisions of these T&Cs be or become invalid, the remainder of the contract shall remain valid. The statutory provisions shall apply in place of the invalid provision.
12.2. We reserve the right to amend these T&Cs where necessary to correct an imbalance or to reflect changes in the legal framework. Amendments apply only to future orders.
